BALTIMORE (AP) - A Baltimore County family is suing a Colorado cantaloupe farm and distributor after they say an 87-year-old man died of listeria.

The suit was filed Thursday in U.S. District Court in Maryland against Jensen Farms and Frontera Produce on behalf of the family of Clarence Wells of Catonsville, a retired printer for the Department of Defense.

Donna Kay Wells Lloyd says her father died Aug. 31 and health officials later told the family that he had the same listeria strain as the nationwide outbreak traced to Colorado cantaloupe.

Lloyd says she knows her father had bought some cantaloupe from a produce market but it's not clear that was the source.

The Department of Health and Mental Hygiene says no other cases of listeria have been reported in the state.
