PHOENIX (AP) - Prosecutors in the Tucson shooting rampage case are again asking a judge to agree there is substantial probability the suspect can regain his mental competency within eight months.

In a filing late Monday, prosecutors say 23-year-old Jared Lee Loughner's commitment for mental health treatment should be extended so he can become competent to assist in his own defense.

U.S. District Judge Larry Burns will consider whether that's probable and whether Loughner can be made mentally fit at a hearing Wednesday in Tucson.

Prosecutors are also asking Burns to deny a hearing to determine whether Loughner can be forcibly medicated to make him competent. Prosecutors say Loughner is being medicated because he poses a threat to himself and others.
