Steven Boyce is accused of driving drunk and crashing into a jeep in the June accident.

His mother Patti Boyce left Frederick county courthouse in tears, while relatives of the Roe family huddled after the brief court appearance.

Steven Boyce waived his right to a preliminary hearing.

Authorities say Boyce’s alcohol level was more than three times the legal limit when he rear-ended a Jeep Cherokee stopped at a light on US 11 at I-81. The Jeep burst into flames, killing Mark and Amanda Roe and their sons Caleb and Tyler.

The Roes had been on their way to the home of Mark's mother for a Sunday picnic.

A state trooper at the scene claimed Boyce's speech was slurred, his eyes were bloodshot and watery and the "odor of alcohol was very strong."

Boyce is charged with one count of involuntary manslaughter, driving under the influence and underage possession of alcohol.
