Judge Benson Legg heard arguments Tuesday on whether Roxana Orellana Santos' case should go to trial.

Santos claims she was targeted because she looked Hispanic when two deputies stopped to talk to her. She was turned over to U.S. Immigration and Customs Enforcement after a background check revealed her illegal immigration status.

Santos' complaint, which also names the county Board of Commissioners, alleges the sheriff's office overstepped its authority under a program that trains officers to check a suspect's immigration status. Santos was not charged in the incident.
