But a spokesman for the U.S. Attorney's office says prosecutors aren't filing charges in the case.

U.S. Park Police spokesman David Schlosser confirmed Tuesday that a person was taken into custody Monday evening following the accusation. He did not release the name of the arrested person. Occupy DC members say the accuser was living in McPherson Square.

Bill Miller, a spokesman for the U.S. Attorney's office, said Tuesday he couldn't comment on the decision to not bring charges.
