Prosecutors say Victor Aldana, 22, was driving with a blood-alcohol level of 0.15 when he struck and killed 8-year-old Brian Hernandez-Chavez on Sunday afternoon along Duke Street.

Aldana will be back in court on Feb. 13 on charges of DUI manslaughter, DUI maiming, reckless driving and driving without a license following an investigation.

Aldana was drunk when he hit Brian Hernandez-Chavez and his mother as they walked along Duke Street on Sunday, authorities say.

Brian was pronounced dead at the scene. His mother suffered two broken legs and a fractured pelvis, but is expected to recover fully.

According to Alexandria police, Aldana was driving westbound on Duke Street when his car ran off the right side of the road, crashing into the young boy and his 31-year-old mother. The boy was killed and his mother broke both of her legs.

“Our crash reconstruction team did an excellent job of figuring out immediately what was going on and he’ll be brought to trial for what he did,”said Ashley Hildebrandt, a spokesperson for the Alexandria Police Department.

Residents say this is a dangerous stretch of road and it was just a matter of time before an accident happened.

“You’re walking right on the side of the street with this being such a heavy traffic area," said Scott Turner, a pedestrian. "You really gotta [be] constantly paying attention and basically just hopeful [that] nothing’s going to happen."
