Gary Giordano, the Maryland man suspected of killing Robyn Gardner in Aruba in 2011, was arrested in Annapolis last Friday for indecent exposure after he was caught allegedly having sex with a woman in a vehicle.

Annapolis Police say Giordano was caught allegedly having sex with a woman in a Cadillac Escalade on May 18 while parked in a garage near City Dock. The garage sits just blocks from the Maryland State House and the U.S. Naval Academy.

"They said they saw two people, so I went up to check it out, and I saw enough to know it wasn't kosher," Frank, the parking attendant who found the couple says. "Just saw enough to know that they weren't clothed.”

The woman with Giordano was also taken into custody. According to charging documents, Giordano could face up to three years in prison and/or a $1,000 fine.

Giordano declined to be quoted about the allegations when reached by phone Tuesday.

"While we recognize that Mr. Giordano enjoys an infamous reputation, the Annapolis arrest was simply a matter of effective police work in response to citizen complaints," Annapolis Police Chief Michael Pristoop said in a statement.

Authorities initially got reports of a man and woman "cuddling" in the back of the Escalade on the second deck of the parking structure.

However, when officers arrived, they say they discovered Giordano and Carol Ann Bock on a mattress in the rear cargo area of the vehicle, lying down and partially covered by a blanket. Police say they saw both Giordano and the woman nude through a window.

Police ordered the pair out of the vehicle. While Goridano was getting out of the Escalade, he knocked his black underwear from the vehicle, police say.

Both were taken into custody and charged with indecent exposure.

"Indecent exposure and other offensive conduct are intolerable," Chief Pristoop said.

An employee of the parking garage told police that several passerbys had complained about the alleged activity in the vehicle. When the employee went to investigate, he saw Giordano and the woman “cuddled together” and could see that Giordano was naked, according to a police report.

Giordano was held in Aruba for several months on suspicion of involvement in the presumed death of 35-year-old Gardner of Frederick.

Her body has not been found. Giordano denies wrongdoing and says Gardner was swept out to sea while snorkeling. He never was officially charged with a crime in connection to Gardner's disappearance.
