Gary Giordano is suing the insurance company that provided a million-dollar life insurance policy on Robyn Gardner, who disappeared in 2011 in Aruba, the Chicago Sun-Times reports.

According to documents obtained by the Sun-Times, Giordano is suing AmEx Assurance Company for a $3.5 million benefit, which he says he paid the premiums on, in connection to what he claims is the presumed death of Gardner.

Giordano told The Associated Press the lawsuit speaks for itself and declined further comment.

Gardner went missing while snorkeling off the coast of Aruba in August of 2011. The 36-year-old Maryland resident has not been seen since. Giordano was held on the island as a person of interest for several months before being released just after Thanksgiving last year.

In an interview with ABC's Good Morning America shortly after his return to the United States, Giordano vehemently denied that he had anything to do with Gardner's disappearance.

During that interview, Giordano said that the accidental death policy he took out on Gardner was part of a travel insurance package that covered both them. He said he takes out policies as such because he wants his three sons to be protected if something happens.

"If I go traveling and I disappear, I want them to be covered. I maxed out on everything," Giordano said.

He also disputed reports that he and Gardner were diving in an area less traveled by tourists.

"We were 100 yards from scuba diving store with tanks in back," Giordano said when asked about the sea conditions when he and Gardner went diving. "It was not a 'remote location.'"

Richard Forester, the man who was dating Gardner when she disappeared last year, told the Sun-Times that Giordano is just trying to profit off of her disappearance. Giordano claims he has full right to the insurance benefit, though, because he paid the premiums.

Giordano recently found himself in trouble again. He was arrested late last month in Annapolis on charges of indecent exposure after police say he was caught having sex in the back of an SUV in a public parking garage
