Lawyers for Curtis Lopez urged a judge Wednesday to preclude from testifying a doctor who examined the fractured skull William McQuain after the child was found dead last October after being bludgeoned with a baseball bat.

Lopez is accused of killing the boy as well as his mother, Jane McQuain, whose body was found inside her Germantown apartment.

Defense lawyers said the testimony would put them at a disadvantage since their experts didn't have their own chance to examine the child's skull, which could help determine the order and number of blows. Lopez was arrested after fleeing to Charlotte, N.C.
