ROCKVILLE, Md. (AP) - Maryland prosecutors have agreed to not seek the death penalty against a man charged with killing his estranged wife and her 11-year-old son.

Stefanie McCardle, a state public defender representing Curtis M. Lopez, revealed the decision during a pretrial hearing Tuesday in Montgomery County Circuit Court.

Lopez is accused of killing Jane McQuain in her Germantown apartment and fatally beating her son, William, with a baseball bat. William's body was found last October in a wooded area miles from the apartment where he lived with his mother.

Lopez was arrested at a motel in North Carolina after driving Jane McQuain's car there.

Lopez sat silently in a green jail jumpsuit during the daylong hearing.
