A D.C. Superior Court judge dismissed a lawsuit filed by three D.C. police officers who say they were retaliated against after testifying about the District’s faulty breathalyzers, the Washington Post reports.

The judge ruled that no jury would find that MPD officers Benjamin Fetting, Jose Rodriguez and Andrew Zabavsky were mistreated because of their lawsuit.

The officers alleged that they refused to back down and decided to testify about the District’s breathalyzers, which the D.C. Police said in 2010 were faulty.
