Court Upholds Maryland Foreclosure Notification Process

The state's highest court has found nothing unconstitutional about Maryland's foreclosure notification process, even though a homeowner might not receive the notice before the property is sold.
The opinion by the Maryland Court of Appeals says it would be up to the legislature to make any changes. The law requires that foreclosure plans be published in a newspaper and sent to the homeowner via regular and certified mail about two weeks before the property is sold. If the owner doesn't receive the message, the owner could still lose the home.
Joyce Griffin of Pasadena went to court after learning she had lost her home in a foreclosure sale. Her attorney argued that personal service of the foreclosure notice should have been required to guarantee due process.
