The Virginia chapter of the American Civil Liberties Union says it's concerned about the Loudoun County (web|news) sheriff's plan to check the immigration status of suspects.

Loudoun County Sheriff Stephen O. Simpson said Tuesday that he made an agreement with U.S. Immigration and Customs Enforcement to check the immigration status of people arrested in the county who are suspected of being in the country illegally.

Simpson says the program will start this summer. He says deputies won't check suspects only based on their ethnicity.

The ACLU said it has filed a Freedom of Information Act request with the sheriff's office, asking for records related to the program.

The ICE program aims to deport illegal immigrants convicted of serious felonies. It is also used in Prince William County (web|news), Manassas, Manassas Park and Herndon.

Information from The Washington Post.

The ACLU's concern about ethnic profiling is valid, but a well-lawyered, court-tested and carefully monitored program of law enforcement is possible and working in Prince William County and Arizona, among other places.  Criticism of enhanced immigration law enforcement is often founded on the faulty reasoning that because Latinos are disproportionately affected, they are somehow being unfairly targeted.  The truth is that the vast majority of illegal aliens in this area are Latinos, and if police have probable cause to suspect they are here without papers, they are being identified based on their undocumented status, not their ethnicity.
