Maryland U.S. Attorney Being Vetted for Federal Judgeship

A law enforcement official says Maryland U.S. Attorney Rod Rosenstein is being vetted as a possible nominee for the 4th U.S. Circuit Court of Appeals in Richmond, Virginia.
The official, who spoke on the condition of anonymity because Rosenstein has not been nominated, said the FBI is performing an extensive background check on Rosenstein.
Maryland Attorney General Douglas Gansler says the FBI contacted him as part of the investigation of Rosenstein, a Republican who became U.S. attorney in June 2005.
Five of the court's 15 allotted judgeships are vacant, leaving it with five Republican and five Democratic appointees. The panel handles cases from federal courts in Maryland, North Carolina, South Carolina, Virginia and West Virginia. It has heard some of the country's biggest terrorism cases, including that of September 11th conspirator Zacarias Moussaoui.
