Maryland's highest court has ruled that pharmaceutical maker Eli Lilly and Co. isn't liable to a third party in a fatal crash caused by a diabetic driver who used the company's medication.
The Court of Appeals upheld a lower court decision granting summary judgment to Eli Lilly in a lawsuit brought by Mary Gourdine, the widow of a Prince George's County councilman who was killed in a 2002 accident on the Capital Beltway. Isaac Gourdine's car was rear-ended when another driver, Ellen Crews, suffered an adverse reaction to her medication.
In the ruling, the Court of Appeals agreed that Lilly did not owe a "duty of care" to Gourdine based on foreseeability that such an accident could occur.
