Five men are being held in a Fairfax County (web|news) jail simply because they might have witnessed a killing.
The men are illegal immigrants. Federal immigration officials told Fairfax City police that the witnesses were waiving deportation hearings and could return to Honduras before the trial. So police obtained "material witness" warrants against the men and had them jailed without bond, even though the trial might not occur for another year.
The men have been in jail for nearly a month now.
Legal experts and the men's lawyers have expressed outrage at the situation.
But Fairfax prosecutors say illegal immigrants often fail to show up to testify. They say they have to do everything possible in the fatal stabbing of 36-year-old Adulio Morales-Bonilla.
