A World War II veteran is fighting to keep his American flag waving in Spotsylvania County.


"I think I deserve to fly my flag," 84-year-old Phil Stack said.

Stack placed a 16-foot pole in his front yard of his property in the Salem Fields subdivision. Eight months later, his homeowners association has asked him to take it down. The Salem Fields HOA property manager, said Stack can attach the flag to his house or garage, but states the association does not allow flagpoles.

ABC 7 News myTAKE - What's Your Opinion?Stack said many of his neighbors tell him they have no problem with the display. Stack said one man even offered him $100 to keep the flag on the pole.

Stack has until October 16th to comply, or he could be fined.

I live in an HOA and we actually caught our HOA off guard on a couple of things they thought they could wite us up for (minor). They were NOT in the bylaws, therefore had NO power to enforce them. We either said close the loophole or don't enforce something you don't have any control over. With this said, he has every right to put up a flag pole and should NOT be forced to take it down. Sometimes these HOA's just get bored and actually FIND things to cite people on (yes, this actually happens in Countryside and Cascades in Sterling where we're from, and we got them on a few technicalities they were not authorized in citing - they shut up real quick and dropped the citation in fear of lawsuits). Sometimes they're so inconsistant it's rediculous!!! We'll call them on ANY citation we get, and you know what, each one we have EVER brought up (there has only been 2-3), they dropped....strange isn't it???? What REALLY got me is that the HOA at this person's residence has a flagpole at their office...talk about do what I say and not what I do policy. Granted, it keeps the neighborhood looking nice (just look at parts of Sterling Park - it's a disgraceful DUMP in some areas where there isn't an HOA...), but they have to know where their boundaries are. It's up to us residents to clearly state those boundaries they loose sight of!!! Don't be afraid voice your opinion, you pay HOA fees, they work for YOU! End of statement.
