Deandre Williams sentenced for robberies, assaults

A group that started as a hip hop and dance group called Show Out had some members who graduated to felonies.

At D.C. superior Court Friday, two members were sentenced for multiple beatings and robberies.

Court documents say Show Out members roamed northwest D.C., robbing and assaulting people at will. A security camera last June 5 captured images of them at a Chinatown bus stop at 3:20 a.m., where some members took a man's iPhone and beat him unconscious.

Deandre Williams, facing sentencing Friday, told the judge, “after viewing the video of my actions, I felt like an animal.”

He was sentenced to 11 and a 1/3 years.

Williams lawyer talked about the youths' troubled childhood.

The judge said it wasn't about robbery, it was about violence, noting while Williams was a fugitive in the D.C. case, he was arrested in Maryland for beating a homeless person.

Paul Noland accused of showing child porn to child in Arlington

Disgust and shock - that's what many Arlington residents are feeling after hearing that one of their neighbors, 19-year-old Paul Noland, is under arrest for allegedly sexually abusing a boy who is just 4-years-old.

Police say Noland lured the little boy into a pickup truck on 8th Street in Arlington. In the car, police say, Noland showed him pornographic images on his iPad, then began touching the boy.

It all happened on the 3600 block of 8th street while the boy’s parents were outside nearby.

“It's pretty surprising, everyone around here is pretty friendly and looks out for each other,” says Kris Coronado, an Arlington resident.

The incident happened at dusk, just about 8 p.m., last Tuesday. Neighbors in the picturesque neighborhood say they're upset but won't let fear control their behavior.

Police say Noland is currently being held without bond. Police add that Noland lives with his parents in Arlington. A woman who says she is his mother declined an interview.

James Manring sentenced to 14 years in child porn case

A preschool teacher who previously pleaded guilty to producing child pornography using several of his students has been sentenced to 14 years Friday.

Authorities say James Manring, 54, filmed the sexual abuse of his 5-year-old students while teaching in Japan. He also taught preschool in Bethesda prior to his arrest in November.

Manring filmed himself performing sexual acts on his students from 1996 to1999, police say. In 1999, he returned to the United States and brought DVDs containing the child pornography with him.

Police caught on to Manring during a national operation known as Operation Spade.

Claude Alexander Allen arrested for homicide in Gaithersburg

The 20-year-old son of a former aide to President George W. Bush was charged in Gaithersburg on Friday, accused by police of killing a man with a hatchet.

Claude Alexander Allen III, of Gaithersburg, was arrested by Montgomery County police and online court records show he's been charged with first-degree murder.

The killing occurred at the Gaithersburg home that property records show is owned by Allen's mother and father, Claude A. Allen.

Police say they were called to the home around midnight by a man who said he had killed someone who had tried to break into his home. Officers who arrived determined that it wasn't a break-in, and police say the younger Allen, and the victim, 25-year-old Michael Phillip Harvey, knew each other. Harvey's body was found in woods outside the home.

“We have no signs of forced entry,” Says Capt. Jim Daly of the Montgomery County Police. “At this point our information is that this occurred shortly before we were called. Because we did not have a forced entry here we believe that the two parties did know each other.”

Police didn't immediately reveal a motive.

The suspect lived with his parents and three siblings. He was a student at the University of Richmond, initially starting there on an Army ROTC scholarship, until he dropped out in the Spring of 2012.

The elder Allen was a former domestic policy adviser in the Bush White House. He resigned in 2006 after being arrested for shoplifting at a Target store in Gaithersburg. He pleaded guilty to theft that same year, effectively ending a once-promising political career, and was fined and placed on probation.

He told the judge at his sentencing hearing that he had lost perspective while working long hours and getting little sleep in the aftermath of Hurricane Katrina. He's been a member at Covenant Life Church, an evangelical church in Gaithersburg.

"The very sad story being reported in the news today is the only information we have at this time. We are grieving and praying for the family of the victim, the Allen family and all involved," church spokesman Don Nalle said in a statement.

Those who knew the family are shocked by what happened overnight.

“I'm surprised because this family seems to be a very nice family,” says neighbor Mavra Diavadis.

Julian Dawkins shooting: CME rules it a homicide; charges pending on Craig Patterson

Based on autopsy results, the death of Julian Dawkins has been ruled a homicide on Thursday evening.

After the homicide ruling, the victim’s father, Curtis Dawkins, says it doesn’t mean anything unless charges are filed. He believes his son was murdered.

"If you're going to claim something to be a homicide, there need to be some results that go along with that ruling," Curtis Dawkins tells ABC7. "So I'm not impressed by them saying it's a homicide."

Dawkins was shot early Wednesday morning, May 21, in the 100 block of Lynhaven Drive in Alexandria. Authorities say a 17-year veteran of the Arlington County Sheriff’s office, Craig Patterson, shot and killed Dawkins.

Friends on Thursday gathered at the spot where 22-year-old Julian Dawkins was shot. Meanwhile his family waited a short distance away for word of charges.

The victim's family wondered why, a full day after the shooting, Patterson did not face charges.

On the night of the shooting, the Dawkins family gathered at the house to plan a party for cousin Tierra Ruffin-Pratt, who had just signed to play with the Mystics of the WNBA.

His uncle says sometime after 9 p.m., Dawkins left and just down the street got into an argument with Patterson, who lives nearby. He is adamant that several hours passed between the first altercation and the shooting.

The Dawkins say that since Patterson is a law enforcement officer whom they believe must have undergone training in conflict resolution, the shooting is all the more troubling.

The Commonwealth’s Attorney, however, says the fact that Patterson is a law enforcement officer doesn’t influence whether he is charged or not charged in the shooting.

The Commonwealth’s Attorney says a decision on whether Patterson is charged or not will be made within 24 to 48 hours.

Alexandria Mayor William D. Euille issued the following statement Thursday evening:

The death of Julian Dawkins, who was shot and killed on May 21, has raised concerns throughout our community. I am confident that appropriate justice will prevail once all facts are known. Our Police Department is investigating this case and they are working with the Office of the Commonwealth’s Attorney using the standard procedure used for such cases in Alexandria. In the meantime, I urge the community to be patient, and allow the justice system to do its work.

WASHINGTON (AP) - A former elementary school teacher who was on the FBI's list of most wanted fugitives is due in federal court on a child pornography charge.

Eric Justin Toth is scheduled for a preliminary hearing Thursday afternoon in Washington.

He was arrested in Nicaragua last month after five years on the run. The FBI last year added him to its "Ten Most Wanted" list to try to drum up attention to the case.

In 2008, Toth was escorted from the campus of Beauvoir, an elementary school on the grounds of the National Cathedral, after another school employee reported finding images of child pornography on a school camera in Toth's possession.
Maryland State Police trooper critically injured in Denton hit-and-run

No charges are being filed against the three teens who hit and dragged a Maryland State Police trooper with their car Wednesday night, officials say.

Maryland State Police officials say that the trooper has been upgraded from critical to serious condition after the crash, which happened at about 7:15 p.m. Wednesday in Denton.

State Police officials say the off-duty trooper, an 8-year veteran of the force, got out of his car and approached three young people in a car who he believed were committing an act of vandalism. While he was speaking to the youths, police say the driver of the car punched the gas and dragged the trooper down the road. After the trooper fell into the roadway, the suspects fled.

However, after finding and questioning the suspects, police say the teens were trying to move a trash can out of the roadway with their car. At one point one of the passengers reached out a window and tried to move it further. When the officer, who did not display his badge or any identification, approached, officials say the teens may have instinctively sped away in fear.

The trooper, who is based out of the Easton barrack, was flown to the University of Maryland Shock Trauma Center to be treated for his injuries.

Rick Curl sentenced to 7 years

Rick Curl, the prominent United States swimming coach who pleaded guilty to sexually abusing one of his students in the 1980s, was sentenced Thursday to seven years behind bars.

Curl pleaded guilty Feb. 21 to sexual abuse of a minor. He faced up to 15 years in prison on the charge, which was levied against him in July of 2012.

"Every day of my life has been spent thinking and feeling awful about my behavior," he told the victim in court.

His victim, Kelley Currin, now in her 40s said that the abuse happened over span of three years while she competed at the Curl-Burke Swim Club.

Curl began touching her inappropriately when she was 13 and had a sexual relationship with her when she was between the ages of 15 and 18.

"I trusted him, and my parents trusted him, everybody trusted him, and that trust was broken," Currin said last July.

Curl's lawyers pleaded for leniency, saying he admitted to the abuse in a letter to the victim's parents and in a 1987 financial settlement he reached with them. They said he had pleaded guilty, instead of going to trial, and had never committed another act of sexual abuse.

"Mr. Curl didn't deny it, he didn't take it to trial, he hasn't misled anyone in the courtroom," said one of his lawyers, Tom Kelly.

Curl, a Vienna native, was arrested in late October on those charges, a month after he was banned for life by USA Swimming.

Curl ran one of the nation's largest swim clubs near D.C. and coached 1996 and 2000 Olympic gold medalist Tom Dolan.

Jodi Arias trial: Jury dismissed after deadlock on penalty; retrial set

PHOENIX (AP) - The jury in Jodi Arias' trial was dismissed Thursday after failing to reach a unanimous decision on whether the woman they convicted of murdering her one-time boyfriend should be sentenced to life or death in a case that has captured headlines worldwide with its sex, lies, violence.

A new panel will be seated to try again to reach a decision - unless the prosecutor takes execution off the table agrees to a life sentence. The judge scheduled a retrial for July 18.

In announcing the mistrial, Judge Sherry Stephens gave a heavy sigh and said: "This was not your typical trial. You were asked to perform some very difficult duties."

Later, as the jury filed out of the courtroom, one female juror looked at the victim's family and mouthed, "Sorry."

Arias, who first said she wanted to die and then that she wanted to live, looked visibly upset about the jury deadlock. She sobbed in the courtroom before the mistrial was announced. Her family didn't attend Thursday but has been present for much of the trial.

Family members of the victim, Travis Alexander, also cried in court.

Jurors began deliberating Arias' sentence Tuesday and first reported they had failed to reach a unanimous decision the next day. Stephens instructed them to keep trying.

Maricopa County Attorney Bill Montgomery on Thursday thanked the panel in a statement: "We appreciate the jury's work in the guilt and aggravation phases of the trial, and now we will assess, based upon available information, what the next steps will be."

He said a status hearing has been set for June 20, "and we will proceed with the intent to retry the penalty phase."

The same jury on May 8 found Arias guilty of first-degree murder in the death of Alexander, who was stabbed and slashed nearly 30 times and nearly decapitated at his Mesa home. It later determined the killing was cruel enough to merit consideration of the death penalty.

Under Arizona law, a hung jury in a trial's death penalty phase requires a new jury to be seated to decide the punishment. If the second jury cannot reach a unanimous decision, the judge would then sentence Arias to spend her entire life in prison or be eligible for release after 25 years. The judge cannot sentence Arias to death.

Former Maricopa County Attorney Rick Romley has said the case could drag on for several months as the new jury reviews evidence and hears opening statements, closing arguments and witness testimony in a "Cliffs Notes" version of the trial.

However, if the prosecutor decides not to pursue the death penalty a second time, the judge would sentence Arias to one of the life term options, and the trial would conclude.

The verdict came two days after Arias spoke to jurors and pleaded for her life. She said she "lacked perspective" when she told a local reporter after her conviction that she preferred execution to spending the rest of her days in jail. She also told jurors she could bring about positive change in prison by teaching inmates how to read and helping launch prison recycling programs.

That night, Arias gave a series of media interviews from jail, telling reporters out about her many fights with her legal team and her belief that she "deserves a second chance at freedom someday."

Arias, 32, contends she killed Alexander in self-defense when he became enraged after a day of sex, forcing her to fight for her life. Prosecutors say she attacked him in a jealous rage because he wanted to end their relationship and go to Mexico with another woman.

Her case became a sensation from the beginning as Arias gave a series of jailhouse interviews following her 2008 arrest in which she blamed the killing on armed, masked intruders.

She went on trial in January, and the case provided endless amounts of cable TV and tabloid fodder, including a recorded phone sex call between Arias and the victim, nude photos, bloody crime-scene pictures and a defendant who described her life story in intimate detail over 18 days on the witness stand.

The former waitress told jurors of an abusive childhood, cheating boyfriends, dead-end jobs, her sexual relationship with Alexander, and her contention that he had grown physically violent.

The trial was streamed live on the Internet and became a real-life soap opera to people around the globe. Some even traveled to Phoenix to attend the trial and became fans of the fiery prosecutor, Juan Martinez, who repeatedly tangled with Arias during her testimony. They sought his autograph outside court and had pictures taken with him, prompting the defense to argue for a mistrial. Their request was denied.

The verdict brings a close to the trial's penalty phase, which also featured dramatic statements by Alexander's sister and brother as they described how their lives were shattered by the loss of their beloved sibling.

Alexander, 30, overcame a tough upbringing in Southern California to become a successful businessman at a legal insurance company and a source of inspiration to his colleagues, his friends at his Mormon church and his family.

The judge had told jurors they could consider a handful of factors when deciding Arias' sentence, including the fact that she has no previous criminal record. They also could weigh defense assertions that Arias is a good friend and a talented artist.

Arias found it difficult to resist the spotlight throughout her case. She spoke to a Fox affiliate minutes after her conviction, and did a series of jailhouse interviews just hours after the jury got the case in the penalty phase.

"The prosecutor has accused me of wanting to be famous, which is not true," Arias told the AP on Tuesday in an interview where she combed her hair beforehand and wore makeup for the cameras. She also insisted that no images be transmitted of her from the waist down, showing her striped jail pants and shackled ankles.

Arias' attorneys tried without success to withdraw from the case several times during the trial, once after Arias gave her post-conviction TV interview, and another in the middle of her sentencing phase.

Justin Wolfe: Appeals court allows new trial

RICHMOND, Va. (AP) - A federal appeals court will allow Virginia to pursue a capital murder case against an alleged drug kingpin from northern Virginia.

In a 2-1 ruling, the 4th U.S. Circuit Court of Appeals in Richmond overturned a federal judge in Norfolk who had ordered a halt to the prosecution of Justin Wolfe and his immediate release. The judge said misconduct by prosecutors in Prince William County made it impossible for Wolfe to get a fair trial.

But a majority on the appellate court disagreed. They ruled that a new trial can be done fairly. A dissenting judge said the misconduct was so bad that freeing Wolfe was the only proper outcome.

Wolfe was sent to death row in 2002 for a drug-related murder, but his original conviction and sentence were overturned.

Harry Easter convicted of vehicular manslaughter in triple fatal

It happened in the blink of an eye.

A drunk driver killed Tim Demby's wife, his wife's sister and her husband. Demby himself was badly injured. He says nothing has been the same since that night on Indian Head Highway June 2011.

On Wednesday, everything changed for that drunk driver. A jury found 36-year-old Harry Easter guilty of 14 charges including three vehicular manslaughter counts for killing Gwendolyn Demby, Cordelia Roberts and Eugene Johnson.

For their survivors, the verdict provides a rare moment of joy.

“I'm relieved to know I’m not gonna see him on the streets anymore,” says Nakita Johnson-Reed. “He doesn't have the opportunity to hurt anyone else’s family he way he hurt ours.”

Prosecutors convinced the jury that Easter had a blood alcohol content of .24, three times the legal drunk driving standard. He was going 89 mph and may have passed out before his SUV slammed into the rear of the small Mazda the two couples from northern Virginia were riding in.

Easter's lawyer claimed in closing arguments that Easter's passenger, who actually owned the truck, was driving. Jurors didn't believe it.

Easter, who'd been free, was put in handcuffs he faces 33 years in prison.

“I just saw a man that was trying to find a way to get out of it like a fly stuck between a screen and a window,” says Tim Demby. “But justice was served today so he has a lot of time to think about it.”

Maria Werts pleads guily to hitting, killing Emmajean Gainey

A Washington woman who admitted to drinking and smoking crack cocaine before hitting and killing a person with her car in April pleaded guilty to involuntary manslaughter Tuesday.

Maria N. Werts, 49, entered the plea less than a month after she struck and killed 58-year-old Emmajean Gainey while she walked on the sidewalk on South Capitol Street in Southwest. She'll be sentenced on July 26.

The plea agreement will lead to Werts spending seven years in prison.

The crash happened at about 2:45 p.m. on April 28. Prosecutors say that Werts had been drinking malt liquor and smoking crack before getting behind the wheel of her car. A short time later, while driving on First Street Southwest, Werts ran a red light and made an illegal right turn onto South Capitol.

Werts then lost control of the car, drove up onto the sidewalk and hit Gainey head-on. The impact pinned Gainey against a tree, killing her instantly. At the time, though, Werts told police that she was only a passenger in the car that hit the victim.

Neighbors said after the crash that Gainey was a beloved figure in the Southwest Washington neighborhood where she lived.

"She was sweet and kind. Everybody loved her," Gainey's granddaughter, Porche, said previously.

Antonio Rogers, Gainey's son, was in court when Werts pleaded guilty.

“My mom – my mom was everything to me,” he says.

Gainey was raising her deceased daughters’ four children, ages 12 to 18. Now, Rogers says he’ll take care of the children.

“I got to them, my sister's kids. I ain't got no choice,” he says. “It's all about sacrificing for your family, you know, you got to do it."

Rogers works at Domino’s Pizza and also takes care of an autistic brother. He also isn’t happy about Werts’ plea.

"Seven years, is not more than a slap on the wrist," he says.

Jodi Arias trial video: Sentencing hearing continues with death penalty chance

PHOENIX (AP) - Jodi Arias returns to court Monday for the continuation of the penalty phase of her trial after being convicted of first-degree murder in the killing of her one-time lover as jurors consider a sentence of life in prison or execution.

Last week, jurors heard tearful comments from Travis Alexander's brother and sister as they described how his killing has torn their lives apart.

Monday begins a new phase of the trial as defense attorneys present witnesses to testify on Arias' behalf in hopes of saving her life.

Judge Sherry Stephens instructed jurors they could consider a handful of factors when deciding what sentence to impose, including Arias' lack of a prior criminal record and assertions that she was a good friend, had an abusive childhood and is a talented artist.

In opening statements, prosecutor Juan Martinez told the panel none of those factors should cause the jury to even consider a sentence other than death, given the brutal nature of the killing.

Defense attorney Kirk Nurmi explained to jurors that Arias herself would testify this week.

"When you understand who Ms. Arias is, you will understand that life is the appropriate sentence," Nurmi said.

Arias, 32, acknowledged killing Alexander at his suburban Phoenix home on June 4, 2008. She initially denied any involvement and later blamed the attack on masked intruders. Two years after her arrest, Arias said she killed Alexander in self-defense.

The victim suffered nearly 30 knife wounds, had his throat slit from ear to ear and was shot in the forehead. Prosecutors say the attack was fueled by jealous rage after Alexander wanted to end his affair with Arias and prepared to take a trip to Mexico with another woman.

Jurors convicted Arias on May 8 of first-degree murder, with all 12 unanimously agreeing it was premeditated, after about 15 hours of deliberations over four days.

The panel later took less than three hours to determine the killing was especially cruel, meaning the death penalty would be a consideration for sentencing.

The ongoing penalty proceedings will be the final phase of the trial. Jurors are expected to begin deliberating Arias' ultimate fate this week.

Defense attorneys plan to call to testify an ex-boyfriend of Arias and the defendant herself, among others, as they work to convince the jury Arias' life should be spared.

The proceedings will play out like a mini-trial as the prosecutor will be allowed to cross-examine each witness, and both sides will offer closing arguments before the jury begins deliberations.

Under Arizona law, if the jury cannot reach a unanimous decision on sentencing, the panel will be dismissed and jury selection will begin anew. Another panel would then be seated to hear arguments in only the penalty phase to determine a sentence. If the second panel cannot reach a unanimous agreement, the judge will then sentence Arias to either her entire life in prison or life in prison with the possibility of release after 25 years.

The most anticipated part of the penalty phase will be when Arias takes the witness stand, though exactly what she will say remains a mystery. Within minutes of her murder conviction, Arias complicated efforts for her defense when she gave an interview to Fox affiliate KSAZ, saying she preferred death over life in prison.

It wasn't clear whether the prosecutor would use those words against her in court, given some experts say it might not work in his favor aimed at securing a death sentence.

"Jodi Arias has proven herself to be a conniving manipulator so she may be saying something like this to get a reaction from the jury," said San Francisco criminal defense lawyer Michael Cardoza. "She may be hoping the jury says, 'We won't give her what she wants, and if she wants death, we're giving her life.'"

Cardoza noted that in Arias' case, with so much evidence against her, the defense can still claim some level of satisfaction is they can just keep her off death row.

Arizona defense attorney Thomas Gorman, who has handled dozens of death penalty cases, said Martinez may not need to mention Arias' comments in the television interview to jurors given they haven't been sequestered throughout the trial.

"They just can't avoid it," Gorman said. "If they're at a bar or a restaurant, they're going to see and hear things."

Arias also cannot choose the death penalty. It's up to the jury to determine a sentence. And while death penalty appeals are automatic in Arizona, she could choose not to pursue additional appeals if she indeed wanted to die for her crime.

Earlier this week, after Arias' was interviewed post-conviction, her attorneys asked to be allowed to step down from the case, but a judge denied the request. Legal experts say the decision was not a surprising one because the attorneys have a conflict of interest with their own efforts to try and save her life while Arias has said she'd rather die.

The motion to withdraw will have no impact on the penalty phase of the trial given jurors are not privy to the filing.

Virginia Eastern Shore arson suspects competent to stand trial

ACCOMAC, Va. (AP) - Two people suspected of setting a string of fires on Virginia's Eastern Shore have been found competent to stand trial.

The conclusion followed a court-ordered psychological evaluation of Charles R. Smith II and Tonya Bundick.

Police have said the couple is responsible for most of the 77 arsons on the Eastern Shore since last fall. They were arrested April 2.

The Daily Times reported Friday that the psychological evaluations of Smith and Bundick found that both defendants suffer from depression.

The evaluations reveal that Bundick was subjected to verbal and emotional abuse at home as a child and was physically abused by her father.

The evaluation of Smith notes that he was abandoned by his biological father.

The couple, who are engaged, had sought to keep sealed the reports, but General District Judge Gordon Vincent denied the motion on Wednesday.

Each has been charged with one count of arson and one count of conspiracy to commit arson in connection with a fire at an abandoned structure in Melfa. More charges are expected.

In court documents, Smith told investigators he torched 52 unoccupied buildings and Bundick set fire to 15.
