Stafford mom says daughter sexually assaulted on school bus

A Stafford County mother is outraged that school administrators aren't doing more after she says a boy assaulted her 13-year-old daughter on a school bus earlier this month.

During the incident, which happened on May 9, the mother says her daughter had her breast grabbed by the alleged assailant.

"He grabbed her breast and told her he was going to rape her," he mother, who declined to be identified, said.

She says it wasn't until that evening that officials at the Shirley Heim Middle School notified her of what happened. By then, her daughter had sat in class with and had ridden home on the bus with her alleged attacker.

She went to the school the next day to complain that something had to be done.

"I told them if it had happened in the workplace, the guy would have been fired," she says.

By Friday, a full week later, the boy was back riding the bus with her daughter.

"After I called the news, they told me he wouldn't be riding the bus anymore," she said.

A spokeswoman for the school district told ABC7 she couldn't talk about any disciplinary problems. But ABC7 did learn that the Stafford County Sheriff's Office is investigating the incident.

The mom says her daughter no longer rides the bus with or takes a class with the boy, but she is hoping the school will reevaluate how this was handled.

Arlington residents petition for, against field lights

Surging growth for an Arlington school is prompting concerns among its neighbors, but the biggest worry is focused on one small part of that growth centered around youth sports.

The problem is not necessarily the elementary school to be built on the campus of Williamsburg Middle School or the doubling of the school-aged population, but it’s the lights.

“All of a sudden I’m going to have stadium lighting in my bedroom,” says Donna Heivilin.

Heivilin signed a petition against lighting the middle field, which is basically Judy Hadden’s back yard.

Hadden is one of 136 Rock Spring neighbors who signed the petition asking Arlington County to keep the so-called dark sky lights found at Long Bridge Park completely dark.

The Arlington Soccer Association’s competing pro-light petition has nearly 10 times the number of signers.

"Lacrosse for kids, football for kids, frisbee for kids. Those are all growing as well at really incredible rates and all those groups need rectangular fields," Justin Wilt of the Arlington Soccer Association.

The ASA recommends a light curfew of 9:30 p.m. and reserving the fields for youth sports only, but the county would have to enforce that.

“I don’t think we have any guarantee," says Hadden.

“We feel they’ve made a decision and slammed it down our throats,” says Heivilin.

But this match isn’t over yet. Just down the street, the neighborhood around Bishop O’Connell High School fought lights and won.

Study: Are mothers smarter than non-mothers?

There are many differences between women who choose to be mothers and those who choose not to be, but a new study is pinpointing a difference that some people may not believe.

The study aims to figure out what is happening in the brains of mothers. The experiment was done with rats, mothers, and non-mothers, with tasks like navigating a maze and finding food.

“I’ve learned that I can run on a lot less sleep than I thought,” says one mom.

New Arlington moms C.C. and Erin first laughed when they were asked about a new study about mothers being smarter.

“You’re like ‘I took a shower today. Victorious.’ And the getting the baby dressed is an accomplishment.”

A researcher from Longwood University found that there’s more science to being equipped for motherhood. The study claims that mothers can tackle life’s challenges better when it comes to problem solving, handling stress and completing certain memory tasks.

“I would say I feel smarter when I look at other non-mothers,” says C.C. White. “I’m like, I got this.”

“I don’t feel smarter because of lack of sleep. I have a hard time with lack of recall and putting sentences together sometimes,” says Erin Persaud.

Not all mothers agree with the findings of the study.

“I think I was equally as smart before I was a mom and I think that I’m happier now,” says Laury Bezek, who traded in working to be a stay-at-home mom. “There’s more joy, I would say, but smarter, I don’t know.”

Virginia jobless rate falls to 5.2 percent in April

RICHMOND, Va. (AP) - Virginia officials say the state's jobless rate fell in April for the second consecutive month, to its lowest since November 2008.

The Virginia Employment Commission says the state's seasonally adjusted unemployment rate was 5.2 percent in April. That's down from 5.3 percent in March, and down from 5.9 percent a year ago.

Virginia's unemployment rate has been trending down since joblessness peaked at 7.4 percent from December 2009 until March 2010.

The agency says that after falling in February and March, the labor force expanded slightly in April as household employment continued to increase and the number of unemployed fell.

Gov. Bob McDonnell says the lower rate is a direct result of Virginians working together to get economy back on track and more Virginians back to work.

State officials say the April rate is the lowest in the Southeast and the second-lowest east of the Mississippi River.

The Labor Department says the national unemployment rate was 7.5 percent in April.

Solid hiring helped lower unemployment rates in 40 U.S. states last month, the most since November. The declines show the job market is improving throughout most of the country.

Unemployment rates increased in only three states: Louisiana, Tennessee and North Dakota. Rates were unchanged in seven states. California, New York and South Carolina all reported the largest unemployment rate declines in April.

Virginia counties suggest projects under transportation bill

Now that the Virginia Transportation Bill has been signed, every county has a wish list of projects it would like to see get done, but as always, that costs money and takes a lot of time.

Of the $4 billion approved under the transportation bill, $1.5 billion will be coming to Northern Virginia, and the requests are not just for roads and bridges. At Potomac Yard, the city wants $2 million for an environmental impact study for future projects. When it comes to where to spend that money, everyone has a wish list.

In Fairfax County, a big wish on that list is for $20 million to fix the interchange design at the Franconia South Van Dorn area off I-95.

“Anything they could do to help would be an improvement,” says Debbie Hart.

Hart commutes through the area every day and looks forward to the day when the drive makes a little more sense.

“The lanes are difficult and people are always swerving because they see the entrance to I-95 and it gets confusing,” says Hart.

“Everywhere is congested, but I don’t think that’s as bad as some other places,” says Karen Whitaker of Alexandria.

The transit fixes are also in demand in Fairfax, as in other places, including a $9 million request to extend the platform at the VRE station in Lorton.

Fairfax also wants to widen Route 28 from the Dulles Toll Road all the way to Prince William County, where Prince William would like the widening to continue in their area.

“It needs to be widened, absolutely,” says Katheryn Baker.

Baker is all for the project, as long as the hassle of construction delivers results.

“It would have to make a tremendous difference,” she says. “I mean, look how wide it is now and it’s bumper in all the lanes.”

To the east in Prince William County, the county wants to widen the very busy stretch of Route 1 near Occoquan.

Arlington wants $12 million for street improvements, a forward-looking idea in an attractive part of down, according to some.

“I think we need to improve Columbia Pike and make it look better,” says Jacolyn Jackson of Arlington. “It’s definitely a growth area.”

“It’s not like it’s trash out there in the first place, so I don’t know what more improvement you can do,” says one store owner.

Of course there are more requests than there is money, so not all projects will be approved. But the Northern Virginia Transportation Alliance is already reviewing a big list of requests and will likely approve the first round of projects next month.

Snakehead fish moves into Rappahannock River

FREDERICKSBURG, Va. (AP) - The invasive northern snakehead fish has moved into the Rappahannock River.

Department of Game and Inland Fisheries biologist John Odenkirk tells the Free Lance-Star that an angler caught a snakehead last July in Ruffins Pond, which feeds into a tributary of the Rappahannock. Since then, snakeheads have been caught at several sites downriver in the lower Rappahannock.

Odenkirk says the fish likely can now be found anywhere in the river.

He says wildlife officials hope to contain the snakeheads and keep them out of other Chesapeake Bay tributaries.

The snakehead is native to Asia and is a top-level predator that can crowd out native fish.

Loudoun County's Confederate statue creates controversy

A proposal by a Leesburg attorney to remove a statue honoring Confederate soldiers from the property of Loudoun County's courthouse is causing a stir.

On Wednesday the Loudoun Times-Mirror published an opinion piece by attorney John Flannery in which he calls for the statue's removal.

"I'm a person of law, or I wouldn't be upset about this symbol, which represents lawlessness," Flannery told ABC7 while standing near the statue.

"If this entire place was a memorial of some kind, you could look at it differently. If it was at a battlefield even I suppose -- but this is a court of law."

But many we talked to in Leesburg are adamantly opposed to removing the statue from where it stands in front of the county's historic courthouse.

"It's a part of our heritage, and it's important to remember what happened," said Leesburg resident Staci Greenspon.

Flannery says some of his clients have felt uncomfortable after seeing the statue on the courthouse grounds.

"If you're a person of color and your approaching this courthouse, this represents disunion, a disrespect for the law, and slavery," he said.

But many in Loudoun County disagree.

"The people that fought from Loudoun County were probably fighting for Loudoun County, and not slavery," said Richard Gallagher. "It doesn't represent racism, but it is part of our past."

Several African-Americans we talked to who live in Leesburg agreed that the statue should stay up.

"It's just a memorial, it's just history," said Sincere Kirabo. "That's the way I see it. So I don't take offense to it at all."

"What are you going to do, change everything?" said Kelvin Bell. "You can't change the history of what's already happened. They should leave it alone. It's a good example to show what has happened and talk about it."

Flannery says removing the statue would likely require a combined effort from court officials and Loudoun County's board of supervisors.

Unlike nearby Prince William County, Loudoun didn't play host to any major battles during the Civil War. It was the site, however, for the somewhat well-known Battle of Ball's Bluff.

Union troops had hoped to capture Leesburg, but instead encountered disaster at Ball's Bluff, which rises above the Potomac a couple miles from the town.

Loudoun was seen as important during the Civil War in part due to its location on the border with Maryland, which was under Union control but was also a slave state with divided loyalties.

Loudoun itself had divided loyalties. According to loudounhistory.org, many people living in its north and west were Quakers and Germans from Pennsylvania at the start of the Civil War. They largely supported the Union.

But the eastern and southern sections of Loudoun featured a lot of planters with large properties, and their sympathies largely were with the Confederacy.

Loudoun supplied many troops to the Confederate army, but there were also residents who went to Maryland and joined the Union army.

In addition to bordering Union-controlled Maryland, Loudoun also bordered Union-controlled West Virginia, which broke off from Virginia because residents didn't want to join the Confederacy with the rest of the state.

A major movement is underway in part of Fairfax County to increase safety along Kirby Road, a dangerous, windy road.

One of the biggest danger zones is around Chesterbrook Elementary School. There have already been accidents in the area and many more near misses.

Virginia governor's race: How will women's issues play out?

Across Northern Virginia, in the historic town of Manassas, is where the current battle over women's issues - specifically abortion rights - remain a top priority for many female voters.

And that is likely where Virginia attorney General Ken Cuccinelli will try and keep most of the focus, as his rock-solid pro-life record threatens to alienate moderate female voters.

But Democratic gubernatorial candidate Terry McAuliffe is facing female skeptics since a story from a book he wrote in 2007 has re-surfaced in which he admits to attending a fundraiser while his wife was in labor.

Further East in Fairfax, potential women voters said education, women’s rights, children’s issues and health care were priorities.

In Arlington, far from Richmond but close to Washington, where money matters, potential women voters said they were concerned with the economy and jobs. Women’s issues were a huge priority for women ABC7 spoke with.

Cuccinelli recuses office from governor's mansion case

RICHMOND, Va. (AP) - Attorney General Ken Cuccinelli cited a conflict of interest Wednesday as he recused his office and hired a private legal team to represent Gov. Bob McDonnell in matters arising from the politically charged criminal case pending against the former chef at Virginia's Executive Mansion.

Democratic former Virginia Attorney General Anthony F. Troy will lead four attorneys from the Richmond firm of Eckert Seamans providing counsel to McDonnell in his official capacity and others in his office as an embezzlement case proceeds against Todd Schneider and other probes of the mansion's kitchen operations continue.

"Due to the practical conflict previously noted by this office in the case of Commonwealth v. Todd Schneider, ... you and your office are appointed to serve as special counsel to represent (McDonnell) ... for matters related to, or arising from, this case and any other related matters," Assistant Attorney General Ellen Porter wrote in a letter to Troy dated Wednesday.

The conflict is the exposure both Cuccinelli and McDonnell have had to nutritional supplements maker Star Scientific Inc., the subject of a federal securities probe and three shareholders' lawsuits, and its chief executive, Jonnie Williams. Williams gave gifts to both McDonnell and Cuccinelli, some of which they disclosed belatedly or not until after journalists had first reported them.

Williams' company gave McDonnell's campaign more than $100,000 and, in 2011, wrote the governor's daughter, Cailin, a $15,000 check to cover expenses for her Executive Mansion wedding reception, including the bill from Schneider's private catering business. McDonnell never reported the gift on his required statement of economic interests for that year because state law requires elected officials disclose only gifts to themselves, not family members.

Cuccinelli, meanwhile, has accepted more than $18,000 in gifts from Williams since 2009, including more than $6,000 worth of food supplements, and a $3,500 family summer vacation and $1,500 Thanksgiving retreat and dinner at Williams' luxury lodge on Smith Mountain Lake. Cuccinelli amended disclosure statements dating from 2009 last month to add the lake vacations and other gifts that he said had slipped his mind earlier.

Neither Cuccinelli nor McDonnell is charged with wrongdoing, but the FBI is scrutinizing the relationship between McDonnell and Williams. The FBI's interest is related to the securities probe of Star Scientific.

White House 'scandals' may nix McAuliffe's momentum

Inasmuch that the White House suddenly finds itself besieged by scandal after scandal after scandal, however truly scandalous they may or may not be, consider the trickle-down fallout.

Specifically, consider Virginia’s race for governor between Terry McAuliffe (D) and Ken Cuccinelli (R), with the election fewer than six months away.

Various polls have McAuliffe gaining ground on the ultra-conservative Cuccinelli the past couple of weeks, but one has to wonder whether the revelations of the past several days that have put President Obama on the defensive will do likewise for McAuliffe.

Said political talk-show host Chris Matthews of Cuccinelli on MSNBC’s “Morning Joe” program Wednesday: “This is his ticket right now.”

In partial agreement is University of Mary Washington political science professor Stephen Farnsworth, who points to what he believes is the obvious -- but also is quick to add a qualifier.

“I think that drumbeat of scandal coming out of the White House, it definitely could create a problem for Democratic candidates this year,” Farnsworth says. “Even so, understand, there aren’t going to be that many connections between the Obama administration and the McAuliffe campaign – McAuliffe is much more of a Clinton person than an Obama person.”

McAuliffe was – and remains – a close friend and advisor to former President Bill Clinton and former Secretary of State Hillary Clinton.

“But the reality is that Democrats are on the defensive with all these problems,” Farnsworth says, “and when you start having to distance yourself and separate yourself from your party, that’s a problem.”

In case you’ve lost track of the so-called scandals, here’s a refresher:

• The Department of Justice, looking for sources of leaks, seized phone records of Associated Press reporters related to a failed al-Qaeda plot without the organization’s knowledge.
• A criminal investigation has been launched regarding whether the IRS singled out conservative groups for extra scrutiny.
• Republicans continue to lead the charge for more answers about the attack on the U.S. Embassy in Benghazi that left four Americans dead, including the ambassador.

Farnsworth sees similarities between what’s going on now and what went on early in the second term of the previous administration, when the Iraq effort began to rupture at the seams and all manner of “scandals” flooded forth.

And with McAuliffe being a Democrat, it’s guilt by association.

“It was a problem for Republicans when George W. Bush was president,” Farnsworth says, “and increasingly it’s looking to be a problem for Democrats if these scandals keep mounting with the disclosures of the AP phone records and if the Benghazi situation continues to worsen and, of course, the IRS and the Tea Party.

“It might not necessarily hurt McAuliffe but it certainly won’t help him.”

Va. Gov. Bob McDonnell approval ratings at two-year lows, poll shows

RICHMOND, Va. (AP) - Gov. Bob McDonnell has dipped to his the lowest job-approval rating in two years in a statewide poll released Wednesday by Quinnipiac University, but he appears unharmed by his ties to the top executive of a troubled nutritional supplements maker who lavished gifts on McDonnell and his family.

Forty-nine percent of the 1,286 registered voters interviewed from May 8-13 approved of the governor's performance while 28 percent disapproved and 23 percent didn't know.

That's down from his rating of 53 percent in statewide Quinnipiac surveys from February and March and his high of 62 percent in October of 2011, the first year the Connecticut-based university began polling in Virginia, a swing state in the 2012 presidential election.

The findings conflict with another statewide survey just 10 days ago by the Washington Post that found 64 percent of its respondents approved of McDonnell's performance.

The two widely divergent polls come amid news reports that the FBI is asking questions about McDonnell's relationship with Jonnie Williams, the CEO of Glen Allen-based Star Scientific Inc., a former tobacco-products company under a federal securities investigation and the subject of three shareholders' lawsuits.

A separate Virginia State Police investigation continues into kitchen operations at the Executive Mansion under McDonnell. The probe resulted in the March indictment of former Executive Mansion chef Todd Schneider on four embezzlement counts. Schneider alleges in court filings in his case that members of McDonnell's family took food and other supplies for personal use from the kitchen and that he was told to take food from the mansion as compensation for personal services.

Williams gave McDonnell's daughter, Calin, a $15,000 check in 2011 to help her cover costs of her June 2011 Executive Mansion wedding reception, including the bill for catering the event from Schneider's private catering and events firm. McDonnell said he did not report the gift on his statement of economic interests for 2011 because state laws compel state officials only to disclose gifts given directly to them, not to family members.

Few voters are aware of any of that, and even fewer are concerned about it, the Quinnipiac poll suggests.

Only 12 percent felt McDonnell was involved in serious wrongdoing, 16 percent felt he had not, but 65 percent either hadn't heard enough about the controversy or declined to answer. Forty-four percent dismissed it as "just politics," 44 percent knew too little about to answer questions, and just 12 percent felt it was a major issue.

While McDonnell's relationship to Williams hasn't resonated among voters, "that could change depending on developments, but at this point many more voters see the mater as 'just politics' than a major issue," said Peter A. Brown, assistant director of the Quinnipiac University Polling Institute.

The poll found that Virginia's most popular elected figure was U.S. Sen. Mark R. Warner with a 59 percent job-approval mark; 46 percent approved of the performance of Virginia's freshman senator, Tim Kaine.

President Barack Obama's statewide job approval ticked up slightly this month, to 49 percent from 45 percent in March, but still lagged behind his Virginia high of 52 percent in Quinnipiac's polls from January and from last November.

Lt. Gov. Bill Bolling, a Republican who abandoned his bid for governor and is not seeking re-election to a third term, saw his approval mark hold at 37 percent, where it stood in March, while 17 percent disapproved.

The least popular elected entity was the Virginia General Assembly. Thirty-eight percent of respondents approved of the job the legislature is doing, while 42 percent disapproved and 20 percent didn't know or didn't respond.

The poll, conducted from live telephone interviews, had a margin of sampling error of plus-or-minus 2.7 percentage points.

TC Williams High prom nominations stir controversy

Controversy has erupted at Alexandria's T.C. Williams High School after a male student was nominated for prom queen and a female student was nominated for prom king.

Students say the finalists for prom king and queen were announced Monday. They say the male student who was nominated for prom queen had let others know he was interested in running for it. They say the female student who ran for king did so in support of the male student.

The male student told ABC7 he was uncomfortable with the publicity the announcement was getting. Since he is in high school we decided not to name him. The female student will also not be named.

One parent who contacted ABC7 told us she felt the school shouldn't have allowed a male to run for queen and vice versa. Another parent agreed, saying it was taking political correctness too far.

But some at T.C. weren't upset by the announcement.

"If that's what they want to do, I think we should be supportive of it," said senior Mariah Frank. "I personally know both people, the girl running for king and the guy running for queen, and they're great people."

Others disagree.

"A lot of people are upset and they don't think it's fair," said senior Kayla Lewis. "People think that if a guy is running, he should be running for prom king and not queen."

Mason says as a guy he wouldn't want to run for queen because it would be unfair to female students who want the honor.

"I feel like it would ruin the chances of girls to get nominated, and it would just be an awkward situation," he said.

The male student who is one of the three finalists for queen told ABC7 he did not mean to upset anyone by accepting the nomination.

He said he was now strongly considering dropping out of the contest.
Although other students told ABC7 the male student let it be known he wanted to run for prom queen, he said he never intended to try to be queen or king.

The prom is June 1 in Springfield. Students say the winners of king and queen will be announced that night.

ABC7 reached a school spokesperson Monday afternoon who said she would call back on the issue. As of Monday night she had not.

Homeless shelter removed in Arlington County

It took one man to build, but multiple people and trucks to remove. Now an Arlington homeless camp is gone.

For more than five hours Monday, VDOT crews raised the homeless shelter using several bulldozers and other heavy equipment.

“So far ten trucks, 150 cubic yards,” says Bernard Roulston of VDOT.

But this was not your ordinary homeless shelter.

“It was maybe half a football or quarter football field,” says Elizabeth Lee of Alexandria. “It was pretty big.”

“It seems like it too a year or two to develop,” says Todd Martin. “Every day there would be something new, garbage or branches, wood vines. It was pretty remarkable.”

The shelter was nine years in the making and the work and home to one man, El Salvadoran immigrant Francisco Fernandez Diaz.

Speaking through a translator, Diaz tells ABC7 he spent one year building a fence, another year collecting items and one more year building his home.

Using tree limbs, branches, ropes and clothing, he built a fortress that VDOT officials say measured 150 feet by 150 feet. Inside, he created different rooms, including a makeshift kitchen, bedroom, and living room. It’s a real step up, he says, from what this piece of park land previously looked like.

After several complaints from passersby, fearing it could be a haven for crime, VDOT crew came through, much to dismay of some who marveled at its construction.

“I figured if someone’s going to put in that much work building something so intricate, they’re not going to bother me,” says Lee. “They’re not predatory, really.”

County officials have tried getting Diaz into a homeless shelter, but he says he prefers staying on the streets.

Cicadas start to appear in Washington region

The cicadas are here, but they’re not everywhere just yet.

The bothersome bugs are starting to emerge in the Washington area. With their beady red eyes, they are coming out of the ground and losing their shells, making themselves right at home.

“Once they harden they’ll be making their noise,” says Michael White, who started seeing the cicadas last week at his Fredericksburg home.

The cicadas aren’t making much noise now because they are small, but within the next two weeks they will be making a lot of racket.

Cicada sightings have taken place in Northern Virginia and Southern Maryland. Experts say cooler weather has staved off the invasion.

The adult cicadas will be around for about six weeks and will emerge over a period of time.

They haven't been seen in the Washington area since 1996.

"I love cicadas," says Katie Skelton. "I remember being a little girl. I lived in Falls Church and we had just hundreds of them on the ground. It was fun then. I don't know how it's going to be as an adult."

According to one Smithsonian entomologist, the District and Maryland may not see the large number of cicadas that they will in Northern Virginia. Warner temperatures in the coming weeks will lead to a clearer picture of the invasion.

Washington National Cathedral, Mount Vernon win historic grants

WASHINGTON (AP) - Washington National Cathedral and George Washington's Mount Vernon estate each won $100,000 grants Monday, among 24 sites around the nation's capital competing for historic preservation funds.

The earthquake-damaged National Cathedral won the most votes from the public over the past three weeks, earning nearly 1.4 million points in the Partners in Preservation program. The National Trust for Historic Preservation and American Express announced the winners, awarding $1 million in preservation funds to sites in the District of Columbia, Maryland and Virginia.

"We are overjoyed by this vote of support for our restoration efforts," said the very Rev. Gary Hall, dean of the cathedral. "This money will be put to good use restoring this incredible structure."

Mount Vernon won $100,000 to paint, plaster and restore Washington's dining room at his Virginia home. Eleven other sites also won grants ranging from $50,000 to $90,000. Those receiving preservation grants were:

- All Souls Church Unitarian, Washington: $50,000 to repair historic bell tower.
